Tato diplomová práce pojednává o problematice alternativních trestů, kdy se v prvé řadě zabývá samotným pojmem alternativních trestů, dále historickým vývojem a podstatou alternativních trestů, která úzce souvisí s principy tzv. restorativní justice a v neposlední řadě rovněž systémem alternativních trestů. Stěžejním obsahem této diplomové práce je popis hmotněprávní a procesněprávní stránky vybraných alternativních trestů v užším pojetí, a to konkrétně trestu obecně prospěšných prací a trestu domácího vězení a jednoho z alternativních trestů v širším pojetí, a to peněžitého trestu a možnosti jejich uplatnění jako trestních opatření v rámci trestání mladistvých pachatelů a dále srovnání účinné právní úpravy těchto alternativních trestů s právní úpravou obsaženou v zákoně č. 140/1961 Sb., trestní zákon a také srovnání právní úpravy trestu obecně prospěšných prací a peněžitého trestu v České republice s právní úpravou ve Švýcarsku a právní úpravy trestu domácího vězení v České republice s právní úpravou ve Spojených státech amerických.This thesis deals with the issue of alternative sentences and is primarily concerned with the term of alternative sentences, as well as history of alternative sentences and nature of alternative sentences, which is related to the principles of restorative justice and system of alternative sentences. The main content of this thesis is a description of the substantive and procedural page selected alternative sentences in the narrower sense- a sentence of community service and house arrest and one of the alternative sentences in a broader sense- a monetary penalty, and their potential use as a sentences for juveniles and also a comparison of legal regulation of these alternative sentences with the regulation contained in the Criminal Code No. 140/1961 and a comparison of legal regulations of the sentence of community service and monetary penalty in the Czech Republic with the regulation in Switzerland and legal regulation of the sentence of house arrest in the Czech Republic with the regulation in the United States of America
