Cílem této diplomové práce je popsat problematiku podmíněného zastavení trestního stihání a narovnání, jakožto odklony od standardního průběhu trestního řízení. V úvodu práce je vymezen pojem odklon, jeho funkce a základní typy. V úvodní části jsou dále také představeny principy restorativní justice a historický vývoj odklonů v právním řádu České republiky. Jádro práce je tvořeno rozborem platné právní úpravy podmíněného zastavení trestního stíhání a narovnání. Následuje kapitola věnující se srovnání těchto dvou institutů.The aim of the diploma thesis is to describe the issue of the Conditional Discontinuance of the Criminal Prosecution and the issue of the Settlement, as the diversions from the standard course of the criminal procedure. The concept of the diversion, its function and its basic types are defined in the introduction of the thesis. The principles of Restorative Justice and the historical development of diversions in the legal system of the Czech Republic are also covered at the beginning. The core of the thesis analyses the current legal regulations concerning the Conditional Discontinuance of the Criminal Prosecution and the Settlement. The following chapter is aimed at the comparison of those two institutes.
