Tato bakalářská práce se zabývá vztahem evropského a českého vnitrostátního práva se zaměřením na ústavní pořádek ČR. Hlavním cílem je vystihnout vztah obou právních systémů a poukázat na některé rozpory v současné doktríně a v doktríně Ústavního soudu ve vztahu k evropskému právu. Evropská unie je specifickým subjektem mezinárodního práva, který je zároveň postaven na subordinaci a koordinaci členských států. Tento nadstátní subjekt postupně vytvořil autoritativní právní systém relativně nezávislý na právu vnitrostátním a právu mezinárodním. Evropský soudní dvůr pak dovodil základní principy komunitárního práva, které jsou klíčové pro vztah obou právních systémů. Těmito principy jsou zejm. princip přímého účinku a aplikační přednosti. Česká republika přistoupila k Evropským společenstvím dne 1. května 2004. Od vstupu do tohoto nadstátního celku platí vedle vnitrostátního práva na území ČR i právo evropské, jehož vliv dnes prozařuje celým právním řádem. Jelikož je Evropská unie postavena na subordinaci členských států, spočívající jednak v převedení vymezených pravomocí na nadnárodní subjekt a jednak v podřízení se evropskému právu, je nutné tento transfer pravomocí a jeho účinky zakotvit v Ústavě. Zde však nastává rozpor mezi doktrínou Ústavního soudu a částí odborné veřejnosti, zejm. co se účinků evropského práva v právním řádu ČR týká. Zatímco Ústavní soud je spatřuje v čl. 10a, na druhé straně prof. Malenovský je spatřuje v čl. 10 Ústavy. Samotné účinky evropského práva pak musí být, navzdory své přednosti, limitovány ve prospěch materiálního jádra Ústavy. Vstupem Lisabonské smlouvy v platnost se vliv acquis EU na vnitrostátní právo ČR zásadním způsobem nezměnil a Unie je i nadále založena na základních demokratických principech.This Bcwork deals with the relations between the European and Czech national law, focused upon to constitutional order of the Czech republic. Primary goal of this Bcwork is to describe relations between both legal systems, as well as to describe various contradictions in recent doctrine and to disclose the view of the doctrine of Constitutional court in the matters of relations between Czech constitutional law and European law. The European Union shall be regarded as a specific entity of international law, which is based on a subordination and cooperation of its member states. This supranational entity has subsequently created authoritative legal system based on the rule of law, which is relatively independent upon national and international law. Fundamentals principles of Community law, which are pivotal for the relations between European and national law, has been created by the European Court of Justice. In particular, it is the principle of the supremacy and direct effect. The Czech republic has been member of European Communities since May, 2004. Since Czech Republic has entered in the EU, the European law coexists beside the national law and currently, has a significant impact on the whole Czech legal order. Whereas the European union shall be based on the cooperation and subordination of the member states, involving both the transfer of specified powers to supranational entity and, secondly, in subordination to European law, it shall be necessary to be regulated on the constitutional level. However, there comes the contradictions between the doctrine of the Constitutional Court and in professional circles, especially as the effects of European law in the legal order of the Czech republic. Whereas according the Constitutional court, the effects of the European law results from the article 10a of Czech Constitution, on the other hand, prof. Malenovský supposes, that those effects results from the article 10 of Czech Constitution. Regardless of its supremacy, the actual effects of European law shall be limited within national legal order in a favour of the substantial bases of the Czech Constitution. Since the entry into force of the Lisbon treaty, there has been no substantive changes in the matters of the relations between acquis EU and the Czech national law; hancedforth the EU continues to be based on the fundamental democratic principles as before.
