Od 1.1.2010 byl systém trestní sankcí rozšířen o trest (trestní opatření) domácí vězení, které je možné odsouzeným v České republice uložit za jejich protiprávní jednání. Cílem diplomové práce bylo zjistit, zda má nebo může mít tento nový druh sankce dostatečný výchovný vliv pro nápravu pachatele, zpracování základních informací o tom, co je trest domácího vězení, za jakých podmínek je možné jej ukládat a vykonávat. V práci zpracováno srovnání tohoto nového trestu s trestem odnětí svobody, jehož je alternativou a podmínky ukládání tohoto trestního opatření mladistvým pachatelům. Pro doplnění jsou zde zpracovány informace o orgánu provádějícím kontrolu výkonu trestu. Pro zpracování práce bylo zvoleno studium dostupných informačních zdrojů a literatury, na jehož základě byla vypracována teoretická část práce. Názory a vědomosti široké české veřejnosti o tomto druhu trestu jsou zpracovány v praktické části práce.Since 1.1.2010 the system of punitive sanction has been extensived about the punishment (a punitive proceeding) of home confinement. In the Czech republic it is possible to put this punishment to convict instead of the injourious conduct. The aim of this diploma paper was to find if this new kind of punishment has or could have sufficient educational influence on reformation of the offender. The other aims are to work up basic informations about the punishment of home confinement and in which conditions it is possible to give and execute this punishment. In this diploma paper there was worked up a comparison of this new punishment with confinement and conditions of giving this punitive proceeding to young offenders. There are also informations about office which is providing control of execution of the punishment. The theoretical part of this diploma paper was based on studing of obtainable information resources and literature. In the practical part of the diploma paper there are worked up opinions and knowledge of wide czech population about this kind of punishment.
