Tato práce je zaměřena na popis problematiky institutu práva na ochranu zdroje a obsahu informací. První část práce je věnována vymezení, jak je institut práva na ochranu zdroje a obsahu informací v českém právním řádu zakotven, komu je toto právo přiznáno a v jakém rozsahu. Ve druhé části práce je zdůvodněno, v čem lze spatřovat odvození práva na ochranu zdroje a obsahu informací ze svobody projevu a nastíněno, jaké důsledky z této skutečnosti plynou pro možnosti omezení práva na ochranu zdroje a obsahu informací. Ve třetí části práce je na případech z judikatury Evropského soudu pro lidská práva ukázáno, jaká je evropská tendence v rozhodování o mezích práva na ochranu zdroje a obsahu informací a na dvou nejvýznamnějších domácích kauzách poté ilustrováno, do jaké míry je tato tendence respektována v českém právním prostředí.This thesis is focused on the description of the field of institute of the right to protect the source and content of information. The first part of the thesis is devoted to staking out how is the institute of the right to protect the source and content of information guaranteed in the czech system of law, whom is this right awarded to and in what range. The second part of the thesis explains why the right to protect the source and content of information can be considered as being deriveable from freedom of speech and shows what consequences result from this fact for possibilities of limitation of the right to protect the source and content of information. In the third part of the thesis there is shown via cases from practise of the European Court of Human Rights what is the european trend in decision making within limitations of the right to protect the source and content of information and afterwards it is shown via two most significant national causes to what degree is this trend respected in czech legal circumstances.
