Tato případová studie se zabývá analýzou postavení prezidenta v politickém a ústavním systému České republiky. Je časově vymezena roky 1993 až 2008, které jsou důležité jak z hlediska vzniku ústavního pořádku, tak konání prezidentských voleb. Práce je členěna do pěti hlavních kapitol a několika podkapitol. První kapitola poskytuje obecné uvedení do problematiky a seznámení se se základním rozdělením moci v České republice. Další kapitoly poskytují analýzu vztahu prezidenta ke každé složce moci. V práci testuji vzájemný vztah pravomocí prezidenta, tak jak jsou nastaveny v Ústavě ČR, a jeho možnosti ovlivňovat dění ve státě. Ústava ČR přisuzuje prezidentovi věší pravomoci, než je obvyklé v jiných parlamentních demokraciích. Některé jeho pravomoci však nejsou dostatečně vytyčeny a korigovány a může tedy docházet ke kontroverzním či krizovým situacím ve vztahu k dalším orgánům státní moci. V práci jsou analyzovány tyto poněkud nejasně definováné pravomoci a jsou doloženy příklady situací, které se odehrály v našem státě.The problem which is presented in this case study is presidential privileges in the political and constitutional system of the Czech Republic. My goal is to describe the situation between (the years) 1993 and 2008. These years are important for a formation of the constitutional order and presidential elections. The work is divided into five chapters and into several subchapters. The first one provides a general introduction to the topic and a summary of the power division in the Czech Republic. The next chapters cover relationships between a President and the other elements of power. In this essay I investigate how the presidential power described in the Constitution may affect a situation in the state. The Constitution of the Czech Republic gives more power to a President than usual in other parliamentary democracies. Some of the President's competences are not fully defined or regulated. This insufficiency causes some controversial and critical situations in relation to the other parts of state power. These unclear privileges are analyzed in my essay and this analysis is supported with some examples which happened in the Czech Republic
