Diplomová práce se zabývá problematikou svěřenského nástupnictví, tradičního institutu dědického práva, který byl do aktuální české právní úpravy opětovně zaveden s účinností nového občanského zákoníku z roku 2012. V práci je obsažen rozbor aktuální zákonné úpravy na pozadí historických skutečností a vývoje institutu v kontinentálním, především tedy středoevropském právním prostředí. Zvláštní pozornost je věnována analýze nedostatků či nepřesností, jež se v současné úpravě i právní praxi v souvislosti se svěřenským nástupnictvím vyskytují, v práci jsou obsaženy rovněž pasáže, které se zabývají možnostmi potenciálního zpřesnění a dalšího rozvoje stěžejního institutu této práce v blízké budoucnosti.This diploma thesis deals with the issue of fideicommisary substitution, a traditional institute of inheritance law, which was re-introduced into the current Czech legal system with the effect of the new Civil Code from 2012. The thesis contains an analysis of the current legal system on the background of historical facts and development of the institute in the continental, primarily the Central European legal environment. Special attention is paid to the analysis of shortcomings and inaccuracies that occur in the current regulation and legal practice in connection with fideicommisary substitution, the thesis also contains passages that deal with the possibilities of potential clarification and further development of the pivotal institute of this thesis in the near future.
