Tato diplomová práce se zabývá institutem zástavního práva v období práva římského, přičemž byl zejména kladen důraz na právní úpravu tohoto institutu dle kodifikace císaře Justiniána I. Cílem práce je zjistit, jakým způsobem se praxe zástavního práva promítla do úpravy justiniánské a posléze té současné. Na základě tohoto pak budeme schopni vypozorovat případné odlišnosti a zjistit, proč tomu tak vlastně je. Práce je rozdělena do několika kapitol, přičemž úvodní kapitola slouží pro zasvěcení do problematiky. Další kapitola se podrobněji věnuje zástavnímu právu v době římského práva, a nakonec je v poslední kapitole přistoupeno k samotné komparaci římskoprávní úpravy zástavního práva, s tou současnou.This diploma thesis deals with the institute of lien in the period of Roman law, with particular emphasis on the legal regulation of this institute according to the codification of Emperor Justinian I. The aim is to find out how the practice of lien was reflected in Justinian law and later in the current law. Based on this, we will be able to observe any differences and find out why this is the case. The work is divided into several chapters, while the introductory chapter serves for initiation into the issue. The next chapter deals in more detail with the right of the lien in the time of Roman law, and finally, in the last chapter, the comparison of the Roman law regulation of the lien with the current one is approached.
