Diplomová práce se věnuje Výboru pro práva dítěte, který je jedním z lidskoprávních výborů Organizace spojených národů. V rámci práce je věnován prostor rovněž některým z dalších lidskoprávních výborů a stejně tak je v poslední části práce věnován prostor výkladu tzv. soft-law a jeho provádění na národní úrovni. Převážnou část však tvoří vysvětlení pravomocí Výboru pro práva dítěte, zejména pak individuální stížnostní proceduře, podávání periodických zpráv a jejich přezkumu a tvorbě obecných komentářů. Cílem diplomové práce je vytvoření komplexního pohledu na činnost Výboru pro práva dítěte, jeho rozhodovací praxi, včetně analýzy jeho rozhodnutí v posledních letech. Mimo to diplomová práce rovněž odpovídá na otázku toho, jak je obecně prováděna individuální stížnostní procedura spadají pod Úmluvu o právech dítěte a vymezuje rozdíly mezi činností některých z lidskoprávních výborů. V oblasti tzv. soft-law se pak diplomová práce věnuje tomu, jak je toto právo prováděno a dodržováno na národní úrovni a polemizuje o tom, zda je toto provádění dostatečné.The thesis focuses on the Committee on the Rights of the Child, which is one of the human rights committees of the United Nations. Within the thesis, space is also devoted to some of the other human rights committees, as well as to the interpretation of soft-law and its implementation at the national level in the last part of the thesis. The major part, however, is an explanation of the powers of the Committee on the Rights of the Child, in particular the individual complaints procedure, the submission and review of periodic reports and the production of general comments. The aim of the thesis is to develop a complete view of the work of the Committee on the Rights of the Child, its decision-making practice, including an analysis of its decisions in recent years. In addition, the thesis also answers the question of how the individual complaints procedure is generally implemented under the Convention on the Rights of the Child and delineates the differences between the activities of some of the human rights committees. In the area of soft-law, the thesis then looks at how this law is implemented and upheld at the national level and questions whether this implementation is adequate.
