Tato práce se zabývá problematikou místních referend v Česku. Tato práce má teoretickou a praktickou část. Práce je rozdělena do 5 kapitol, které se ještě člení na větší a menší podkapitoly. Teoretická část se zaměřuje na současnou i historickou úpravu zákonnou úpravu místního referenda, což je náplní první kapitoly diplomové práce. Náplní první kapitoly je rovněž popsat evropský kontext místního referenda. Ve druhé kapitole je zpracována přípravná fáze místního referenda. Ve třetí kapitole je popsána samotná realizační fáze spolu platností a závazností místního referenda. Ve čtvrté kapitole je zpracována soudní ochrana místního referenda. V podkapitolách jsou rozebrány soudní ochrany Ústavního soudu a správních soudů. V práci nechybí ani současná judikatura spolu s náhledem odborné literatury. V závěru celé práce dochází ke shrnutí nejproblematičtějších aspektů místního referenda z pohledu autora, kdy tento po komplexní analýze přináší vlastní konkrétní návrhy a úvahy de lege ferenda. Diplomová práce zkoumá právní úpravu k 30. 11. 2023.This thesis deals with the issue of local referenda in the Czech Republic. This work has a theoretical and a practical part. The work is divided into 5 chapters, which are further divided into larger and smaller subsections. The theoretical part focuses on the historical part on the current legal regulation of the local referendum, which is the first diploma thesis. The content of the first chapter is also to describe the European context of the local referendum. The second chapter deals with the preparatory phase of the local referendum. The third chapter describes the implementation phase itself, together with the validity and binding nature of the local referendum. In the fourth chapter, the judicial protection of the local referendum is elaborated. Judicial protections of the Constitutional Court and administrative courts are discussed in the subsections. The work also includes current jurisprudence along with an overview of specialist literature. At the end of the entire work, the most problematic aspects of the local referendum are summarized from the author's point of view, where this comprehensive analysis brings its own specific proposals and considerations de lege ferenda. The diploma thesis examines the legislation as of 11/30/2023.
