Bakalářská práce je zaměřena na otázku participace nezletilých dětí v soudních řízeních o péči. Cílem je zjistit, jakým způsobem soudy, orgány sociálně-právní ochrany dětí z pozice opatrovníka dítěte a další organizace, které jsou do procesu zapojené, usilují o dodržení práva dítěte na participaci v řízení, které se ho přímo dotýká. V teoretické části jsou popsané vztažné pojmy, kterými jsou rodina, manželství a rozvod. Dále je popisováno opatrovnické řízení a formy péče o dítě, o kterých může soud rozhodnout. Samostatná kapitola je věnovaná otázce participace dítěte a otázce nejlepšího zájmu dítěte. Poslední kapitola teoretické části práce se věnuje popisu subjektů, které se nejčastěji v opatrovnickém řízení vyskytují a jejich role ve vztahu k participačním právům dětí. V empirické části práce je proveden kvantitativní výzkum, kdy jsou data čerpána ze spisových dokumentací dětí, kterým bylo město Šternberk jmenováno opatrovníkem pro řízení o péči v roce 2018 a 2019. Empirickým šetřením bylo odpovězeno na dvě výzkumné otázky. Bylo zjištěno, že názor dítěte byl zjištěn u 69% dětí ve věku 9 let a starších a že názor dítěte nejčastěji zjišťoval orgán sociálně-právní ochrany dětí.The bachelor thesis is focused on the issue of the participation of minor chidren in legal proceedings. The aim is to find out how courts, social and legal child protection authorities, as guardians of the child and other organizations involved in the process, seek to respect the child's right to participate in proceedings that directly affect the child. The theoretical part describes the reference concepts, which are family, marriage and divorce. Further, there are described custody proceedings and the forms of childcare that the court can decide on. Separate chapter is focused on the issue of child participation and the best interests of the child. The last chapter of the theoretical part of the bachelor thesis deals with the description of the subjects that most often occur in guardianship proceedings and their role in relation to children's participation rights. In the empirical part of the work, a quantitative research is conducted, where the data are drawn from the file documentation of children, to whom the city of Šternberk was appointed guardian for care proceedings in 2018 and 2019. Empirical proceeding answered two research questions. It was found out that the child´s opinion was discovered with 69% of children, at 9 years and older and that the child´s opinion was mostly found by the social and legal protection of children.
