Tématem diplomové práce je institut veřejných licencí, který představuje inovativní a stále více populární způsob užití autorského díla. V textu práce jsou veřejné licence nejdříve uvozeny otázkou legitimity autorského práva a problematikou vyvažování zájmů jednotlivých subjektů za účelem nalezení vybalancovaného těžiště. Po tomto úvodu jsou dále analyzovány tři stěžejní oblasti, jež zároveň tvoří jádro práce. Do první oblasti patří vymezení veřejných licencí z hlediska jejich historické perspektivy s cílem nalézt důvody jejich vzniku a pochopit smysl a účel existence. Druhou oblastí je poté analýza veřejných licencí z pohledu českého autorského práva, která je provedena nalezením rozdílů oproti standardní individuálně sjednávané licenční smlouvě s primárním zájmem na kontraktační proces smluvních stran a další typické distinktivní prvky. Ve třetí oblasti, jež práci zakončuje, jsou rozebrány nejčastěji využívané typy veřejných licencí s důrazem na jejich charakteristické prvky vycházející z textu licenčních podmínek.The subject-matter of the thesis are public licenses, which are an innovative and increasingly popular way of using copyright works. In the text of the thesis, public licenses are firstly introduced by the question of the legitimacy of copyright and the issue of balancing the interests of the different subjects to find a balanced centre. After this introduction, three key parts are analysed, which also forms the core of the thesis. The first part involves defining public licenses from the point of view of their historical perspective to find the reasons for their uprise and to understand the meaning and purpose of their existence. The second part is then an analysis of public licenses from the perspective of Czech copyright law, which is done by outlining the differences from a standard individually negotiated license agreement with a primary interest on the contracting process of the parties and other typical distinctive elements. The third part, which concludes the thesis, discusses the most commonly used types of public licenses with an emphasis on their characteristic elements based on the text of the license terms.
