Předmětem diplomové práce jsou sociologické a filosofické aspekty trestu smrti. Práce se zabývá především zásadními problémy, které vznikají v souvislosti s aplikací tohoto trestu a mapuje názorové argumenty, které hovoří v jeho prospěch či neprospěch. Práce je členěna do pěti kapitol. Kapitola první vymezuje pojem trestu smrti, jeho historický vývoj v naší zemi, přehled mezinárodních konvencí, které jej upravují a v poslední části této kapitoly jsou vymezeny zásadní problémy související s tímto institutem. Druhá kapitola analyzuje ústřední argumenty pro a proti trestu smrti. Třetí kapitola se zaměřuje na alternativy trestu smrti, které nahradily trest smrti v našem právním řádu. Ve čtvrté kapitole je rozpracována komparace trestu smrti a jeho alternativ z hlediska účinné ochrany společnosti. Poslední pátá kapitola obsahuje výzkumné šetření, které se zabývá názory respondentů v podobě jejich vyhodnocení prostřednictvím tabulek a grafů.The subject of this diploma thesis are sociological and philosophical aspects of the death penalty. The work deals mainly with the fundamental problems that arise in connection with the application of this punishment and also maps the arguments that speak in its favor or against it. The thesis is divided into five chapters. The first chapter defines the concept of the death penalty, its historical development in our country, an overview of international conventions that regulate it. The last part of this chapter defines the fundamental problems related to this institute. The second chapter analyzes the principal arguments for and against the death penalty. The third chapter focuses on the alternatives to the death penalty, which have replaced the death penalty in our legal system. The fourth chapter compares the death penalty and its alternatives in terms of effective protection of society. The last chapter contains a research survey that deals with the views of respondents in the form of their evaluation through tables and graphs
