Tématem této práce je institut generálního inhibitoria. Toto téma bylo zvoleno v souvislosti s dlouhodobým nárůstem zahajovaných exekucí. Cílem této práce je zejména důkladné prozkoumání institutu generálního inhibitoria za účelem zjištění, zda tento institut představuje dostatečnou ochranu majetkových zájmů oprávněného, a zda se nejedná nepřiměřený zásah do majetkových práv povinného a jeho manžela. Práce se skládá z úvodu a dalších sedmi kapitol. Druhá kapitola se věnuje vymezení pojmu generálního inhibitoria. Ve třetí kapitole je rozebrána časová působnost zákazu nakládání s majetkem. V následující kapitole je srovnáváno generální inhibitorium s inhibitoriem speciálním, a to včetně jejich důsledků. Pátá kapitola je věnována prohlášení o majetku povinného. Následující dvě kapitoly jsou zaměřeny na důsledky generálního inhibitoria pro účastníky řízení a třetí osoby. Poslední kapitola je věnována výjimkám a odklonům z institutu generálního inhibitoria. Po hlavním textu práce pak následuje závěr a seznam použité literatury.The theme of this diploma thesis is The institute of general inhibitorium. This theme was chosen in the connection with increasing number of iniciation of execution proceedings. The aim of this thesis is general research of the general inhibitorium for the purpose of finding out if the general inhibitorium represents a sufficient protection of the creditor's property interests and if it is inappropriate encroachment to the debtor's and his/her husband's property rights. This thesis consists of introduction and another seven chapters. The second is dedicated to the definition of the general inhibitorium. The third chapter is devoted to the time scope of this legal institute. The following chapter is devoted to the difference between general and special inhibitorium, including the consequences. The fifth chapter is focused on the debtor's declaration of property. In the seventh and eight chapters includes an analysis of the impact of general inhibitorium on the debtor's husband, bailiff, debtor and third person. The last chapter contains of the exceptions and diversions from the general inhibitorium. After the main part of this thesis there are conclusion and a list of used literature.
