Tématem této diplomové práce jsou zakázané distribuční dohody uzavírané v on-line prostoru. Ve své první kapitole se práce zabývá vymezením distribučních dohod obecně. Následující kapitola je věnována revidovanému nařízení č. 330/2010 o použití čl. 101 odst. 3 SFEU na kategorie vertikálních dohod a jednání ve vzájemné shodě, které je jedním z nejdůležitějších bodů této práce. V této kapitole je rovněž vymezena aktivní a pasivní forma distribuce, a to i s ohledem na změny, které v těchto institutech vyvolává revidované nařízení. Další, třetí kapitola, se zabývá selektivní distribucí a jejími projevy v oblasti on-line distribuce. Čtvrtá kapitola se zaměřuje na specifické problémy, které vyvstávají v oblasti on-line distribuce a demonstruje jejich dopady na soutěžní trh na konkrétních rozhodnutích. Dále jsou zde řešeny povolené a zakázané typy ujednání v systému on-line distribuce a v neposlední řadě postavení e-shopů v rámci soutěžního prostředí. Pátá a poslední kapitola se zabývá samotnými výjimkami z distribučních dohod, které jsou zde vymezeny a současně jsou zde upraveny podmínky pro jejich uplatnění.The topic of this diploma thesis is cartel distribution agreements concluded in the on-line area. In its first chapter the thesis deals with defining the distribution agreements in general. Next chapter is devoted to the revised regulation No 330/2010 on the application of Article 101(3) of the Treaty on the Functioning of the European Union to categories of vertical agreements and concerted practices, which is one of the most important points of this work. In this chapter is also defined the active and passive form of distribution, with regards to the changes that revised regulation evokes in these institutes. The next, third chapter, deals with selective distribution and its manifestations in the area of on-line distribution. The fourth chapter focuses on the specific problems that arise in the area of on-line distribution and demonstrates their impact on the competitive market in concrete decisions. This thesis then deals with permitted and prohibited types of arrangements in the on-line distribution system and last but not least it deals with the position of e-shops within the competitive area. The fifth and last chapter deals with the exceptions from the distribution agreements, which are also defined here and at the same time conditions for their application are regulated here.
