Diplomová práce se věnuje právní úpravě zdanění hazardních her v České republice se zaměřením a důrazem na provoz hazardních her prostřednictvím internetu. V textu práce je věnován prostor nové daní z hazardních her a institutům s ní související. Úvod se věnuje vymezení základních pojmů souvisejících se zdaněním, seznámení s důvody přijetí nové právní úpravy a nastínění provozu internetových her. Diplomová práce obsahuje kritické zhodnocení textu zákona s důrazem na základní konstrukční prvky daně z hazardních her a její správy. Analýzou jsou identifikovány problematické prvky zdanění hazardních her. Cílem práce je zhodnocení regulace zdanění hazardu, která je u účinná od 1. ledna 2017, hodnocení její dostatečnosti a identifikace potřeby změn. K dosažení cíle byla použita metoda analýzy, metoda dedukce, deskripce a komparace s předešlou právní úpravou účinnou do roku 2016.The diploma thesis focuses on the legal regulation of gambling taxation in the Czech Republic, with particular emphasis on the operation of online gambling. Across my thesis, I am looking at the new gambling tax and related institutes. The introduction of the thesis is devoted to the definition of basic concepts related to taxation, then I introduce the reasons for the adoption of the new legislation and briefly outline the operation of online gaming. The last and most important section critically evaluates the text of the law with an emphasis on the basic design elements of the gambling tax and its administration. In the course of this analysis, some problematic elements of gambling taxation are outlined. The most important objective of the thesis is to assess whether the regulation of gambling taxation, which has been in force in the Czech Republic since 1 January 2017, is sufficient and whether any further changes are needed. In order to achieve this goal, I used the method of analysis for the most part, in addition to the method of deduction, description and comparison with the previous legislation in force until 2016.
