Diplomová práce pojednává o tématu náhradního mateřství a zvláštní důraz klade na jeho smluvní povahu. Téma je zpracováno komplexně za využití primárně deskriptivní metody a kompilace odborné literatury. Zohledňuje i širší souvislosti problému, zejména lidskoprávní a etické aspekty. Diplomová práce hodnotí charakter a možnosti uzavírání surogačních smluv z hlediska platného práva, kde dochází k jednoznačnému závěru, že v současnosti nelze uzavřít v České republice vymahatelnou surogační smlouvu. Dále si klade za cíl představit možnou právní úpravu de lege ferenda. Těžiště práce se nachází v identifikaci problematických oblastí kontraktace a zasazení do kontextu ustanovení o závazcích ze smluv.The diploma thesis deals with the topic of surrogate motherhood, and the emphasis is placed upon its contractual nature. The topic is discussed comprehensively while using the descriptive method and compilation of legal literature. It also considers the broader context of the problem, particularly human rights and ethical aspects. The thesis evaluates the nature of surrogacy agreements and the possibilities of the conclusion of such a contract in terms of applicable law, where there is a clear conclusion that it is currently not possible to conclude an enforceable surrogacy contract in the Czech Republic. The thesis aims to provide a possible future form of surrogacy, and the core of the thesis is to identify areas of concern regarding contract law.
