Tato diplomová práce pojednává o problematice určování a popírání otcovství na základě druhé zákonné domněnky. Cílem práce je nejen seznámení s danými instituty, ale také následná analýza právní úpravy a nastínění sporných otázek spjatých právě s problematikou otcovství. Daná práce je rozdělena do šesti kapitol. První část se věnuje objasnění základních pojmů prolínajících se celou prací, jimiž jsou otec biologický, právní a sociální. Druhá kapitola je zaměřena na konverzi první právní domněnky ve druhou. Třetí kapitola se zabývá samotným určování otcovství dle druhé zákonné domněnky. Čtvrtá kapitola pojednává o vztahu souhlasného prohlášení jakožto zvláštního projevu vůle k obecným ustanovením ohledně právního jednání. V pořadí pátá kapitola se zabývá popíráním otcovství určeného na základě druhé zákonné domněnky. Poslední, šestá kapitola je věnována otázce souladu biologického a právního otcovství.This diploma thesis deals with the issue of determining and denying paternity on the basis of the second legal presumption. The aim of the work is not only to get acquainted with the institutes, but also a subsequently provide analysis of the legislation and outline the controversial questions related to the issues of fatherhood. The work is divided into six chapters. The first part is devoted to clarifying the basic concepts which interwine throught the whole work, those being the terms biological, legal and social father. The second chapter focuses on the conversion of the first legal presumption into the second. The third chapter deals with the determination of paternity according to the second legal presumption. The fourth chapter deals with the relationship of the declaration of consent as a special expression of will to the general provisions concerning legal acting. The fifth chapter deals with the denial of paternity determined on the basis of the second legal presumption. The sixth and also the last chapter is devoted to the question of the compliance of biological and legal fatherhood.
