Tématem této diplomové práce je postavení nezletilého v exekučním řízení. Téma bylo zvoleno v souvislosti s problematikou nárůstu počtu případů tzv. dětských dlužníků. Cílem práce je zejména výzkum ochrany a možností realizace práv nezletilých v exekučním řízení, a dále rozbor nové právní úpravy týkající se dané problematiky. Práce sestává z úvodu a dalších 6 kapitol. Druhá a třetí kapitola se věnují uvedení do tématu a popisu práv nezletilých účastníků řízení. Čtvrtá kapitola se týká průběhu exekučního řízení se zaměřením na specifické problémy spojené s účastí nezletilého povinného, tj. zejména zastoupení, doručování apod. Pátá kapitola je zaměřena na některé aspekty související s postavením nezletilého v roli oprávněného v exekučním řízení. Šestá kapitola sestává zejména z rozboru nové právní úpravy týkající se dané problematiky a zhodnocení těchto změn. Po hlavním textu práce následuje závěr a seznam použité literatury.The theme of this diploma thesis is Position of a minor in execution proceedings. This theme was chosen in connection with increasing number of cases of child debtors. The aim of this thesis is research of protection and possibilities of realization of rights of minors in execution proceedings, and also analysis of new legislation regarding this topic. This thesis consists of introduction and another 6 chapters. The second and third chapter is dedicated to introduction to the topic and description of rights of minors. The fourth chapter is devoted to the course of execution proceedings with focus on specific issues related to minors as debtors in this proceeding, for example representation, delivering documents etc. The fifth chapter is focused on some aspects related to minor as creditor in execution proceedings. The sixth chapter consists mainly of an analysis of the new legislation regarding this topic and evaluation of this changes. After the main part of this thesis there are conclusion and a list of used literature.
