Cílem této diplomové práce je provedení studie a zhodnocení současné podoby institutu dohody o vině a trestu, zejména s ohledem na nedávno přijatou novelu trestních předpisů, a posouzení jejího potenciálu do budoucna. Prostředkem k získání poznatků je analýza české a polské úpravy dohodování o vině v trestním řízení. Diplomová práce je rozčleněna do tří kapitol. První kapitola je zaměřena na pojem Plea Bargaining v Common Law. Druhá kapitola je zaměřena na českou úpravu dohody o vině a trestu. Třetí kapitola je zaměřena na polskou úpravu konsensuálních způsobů vyřízení trestních věcí. V závěru je provedeno vypořádání se získanými poznatky a formulace návrhů de lege ferenda.The aim of this diploma thesis is to perform a study and evaluation of the current form of the Agreement on Guilt and Punishment institute, especially with regard to the recently adopted amendment to criminal law, and to assess its potential for the future. The knowledge is acquired through the analysis of the Czech and Polish regulations on bargaining in criminal proceedings. The diploma thesis is divided into three chapters. The first chapter focuses on the concept of Plea Bargaining in Common Law. The second chapter focuses on the Czech regulation of the Agreement on Guilt and Punishment. The third chapter is focused on the Polish regulation of consensual methods of settling criminal cases. In the end, conclusions are made from the acquired knowledge and de lege ferenda proposals are formulated here.
