Tato diplomová práce se zabývá institutem náhradního mateřství a problémy s ním spojenými. Práce je členěna do pěti kapitol. První kapitola obsahuje teoretické vymezení mateřství, rodičovství, náhradního mateřství a obsahuje také historické milníky, které jsou podstatné pro tento institut. Druhá kapitola se věnuje typům náhradního mateřství, ve třetí kapitole jsou rozebrány subjekty a jejich postavení v tomto procesu. Čtvrtá kapitola se věnuje vybraným právním a etickým problémům, jež jsou s náhradním mateřstvím spjaty. Konkrétně jsou v této kapitole řešeny práva rodičů a dítěte, dále problematika surogační smlouvy se zaměřením na její platnost, vymahatelnost a možnosti sjednání úplaty. Pozornost je také věnována osvojení, které tvoří důležitou část procesu náhradního mateřství. Poslední pátá kapitola je zaměřená na posouzení potřebnosti právní úpravy náhradního mateřství a obsahuje návrh právní úpravy de lege ferenda.This diploma thesis is focused on the institute of surrogacy and the problems associated with it. The thesis is divided into five chapters. The first chapter contains a theoretical definition of motherhood, parenthood, surrogacy and also contains historical milestones that are essential for this institute. The second chapter deals with the types of surrogacy, the third chapter discusses the subjects and their position in this process. The fourth chapter deals with selected legal and ethical issues related to surrogacy. Specifically, this chapter addresses the rights of parents and children, as well as the issue of the surrogacy agreement with a focus on its validity, enforceability and the possibility of negotiating remuneration. There is also a brief mension about adoption, which is an important part of the process of surrogacy. The last fifth chapter is focused on assessing the need for legal regulation of surrogacy and contains a proposal for legal regulation de lege ferenda.
