Diplomová práce pojednává o právní úpravě Národní databáze DNA v České republice. Práce se zaměřuje na posouzení ústavní konformity této právní úpravy. V práci je rozebráno právo na soukromí z hlediska Listiny základních práv a svobod a Evropské úmluvy o ochraně lidských práv a judikatura soudů České republiky a Evropského soudu pro lidská práva. Dále jsou v práci vymezeny problematické aspekty národní databáze DNA a její právní úpravy, což je následně posouzeno z hlediska ústavní konformity. Ústavní konformita právní úpravy je posuzována jak ve světle požadavků kladených ústavním pořádkem České republiky a soudy České republiky, tak ve světle požadavků kladených Úmluvou o ochraně lidských práv a základních svobod a Evropským soudem pro lidská práva. Na závěr je pro srovnání v práci uvedena právní úprava této problematiky ve vybraných zemích. Cílem práce je zodpovědět na otázku, zda je právní úprava národní databáze DNA v České republice protiústavní.The master's thesis is concerned with the legal regulation of the National DNA database in the Czech Republic. It focuses on the assessment of the constitutional conformity of this legal regulation. The thesis examines the right to privacy as defined by the Chapter of Fundamental Rights and Freedoms and the European Convention of Human Rights as well as the judicature of both the courts in the Czech Republic and the European Court of Human Rights. The thesis then singles out the problematic aspects of the national DNA database and its legal regulation, and subsequently evaluates them in relation to the constitutional conformity. The constitutional conformity of the legal regulation is assessed both in terms of the requirements posed by the constitutional order of the Czech Republic and the courts of the Czech Republic as well as in terms of the demands placed by the European Convention of Human Rights and the European Court of Human Rights. For comparison purposes, the thesis concludes with an overview of the legal regulation of this issue in selected countries. The aim of this thesis is to answer the question of whether the legal regulation of the national DNA database in the Czech Republic is unconstitutional.
