Tato bakalářská práce se zabývá využíváním odborné poradenské pomoci v oblasti sociálně-právní ochrany dětí v kontextu legislativních možností. V teoretické části si přiblížíme rodinu a její funkce, a rovněž krizové situace vedoucí k rozchodu rodičů. Podíváme se na systém poradenských zařízení, jejich vznik, vývoj a funkce ve vztahu k rodinám. Přestavíme roli orgánu sociálně-právní ochrany dětí v rozchodových situacích rodičů a praxi spolupráce rodičů, poradenských zařízení a OSPOD. Empirickou část tvoří kvalitativní výzkum. Položili jsme tři výzkumné otázky, a to, jak OSPOD využívá legislativní opatření na ochranu dětí v oblasti poradenské pomoci, jak rodiče vnímají a přistupují k opatření ze strany OSPOD, a jaké jsou možnosti efektivnější spolupráce zainteresovaných subjektů. Data byla získaná formou polostrukturovaného interview se 7 rodiči, 6 poradenskými zařízeními, 44 sociálními pracovníky. Jednalo se o záměrný výběr souboru. Pro zpracování dat jsme zvolili zakotvenou teorii. Z výsledků vyplynulo, že opatření daná zákonem nejsou vždy využívána a je zde prostor pro aktivnější a cílenější zaměření k využívání poradenských zařízení rodiči.This bachelor thesis deals with the benefiting of the expert counselling in the area of social and legal protection of children in the context of legislative possibilities. In the theoretical part we will take a closer look into a family and its functions as such and into family crises as well which then often lead to breakups. I will describe the system of the counselling facilities, their establishment, development and functions related to the families. I will also introduce the role of the Authority for Social and Legal Protection of Children in the time when families go through a divorce and cooperation of parents, counselling facilities and the Authority for Social and Legal Protection of Children. The empirical part is carried out by the qualitative research in which I asked three questions. I wanted to know how the Authority for Social and Legal Protection of Children uses the legislation to protect children in the area of counselling, then what the parents attitude towards the Authority for Social and Legal Protection of Children measures is and lastly what the possibilities of making the cooperation more effective are for the involved subjects. Data was collected in the 7 interviews with parents, 6 interviews with the counselling facilities, 44 social workers, who all were intentionally chosen. I analyzed the data according to the theory. The outcome shows that the law precautions are not always applied and my bachelor thesis proves that there is much wider space to use the services of the counselling facilities more actively by parents.
