Předmětem zkoumání diplomové práce je vývoj institutu anticipatorní sebeobrany v současném mezinárodním právu. První část práce je věnována analýze vztahu anticipatorní sebeobrany dle obyčejového mezinárodního práva a kodifikace tohoto institutu v Chartě Organizace spojených národů. Druhá část práce navazuje přehledem podmínek legálního výkonu práva na anticipatorní sebeobranu. Ve třetí části je na řadě příkladů státní praxe z 20. století demonstrován přístup států k anticipatorní sebeobraně a jsou také blíže vymezovány hranice podmínek ancitipatorní sebeobrany. Poslední část práce je věnována reáliím vztahu mezi Spojenými státy americkými a Korejskou lidově demokratickou republikou a je zodpovězena otázka legality případné anticipatorní akce ze strany Spojených států.The subject of the diploma thesis is the development of the institute of anticipatory self-defense in contemporary international law. The first part is devoted to the analysis of the relationship of anticipatory self-defense according to customary international law and codification of this institute in the United Nations Charter. The second part of the thesis follows the overview of the conditions of legal exercise of the right to anticipatory self-defense. In the third part, the approach of states to anticipatory self-defense is demonstrated on a number of examples of state practice from the 20th century and the boundaries of conditions of ancitipatory self-defense are also defined. The last part of the thesis is devoted to the realities of the relationship between the United States of America and the Democratic People's Republic of Korea and the question of the legality of any anticipatory action by the United States is answered.
