Tématem předkládané diplomové práce je zejména univerzalita lidských práv a různé pokusy o její ne-metafyzickou obhajobu, tedy tzv. justifikační teorie. V první kapitole uvádím především klasifikaci takových teorií od Roberta Alexyho. V druhé kapitole rozebírám pohledy jednotlivých teoretiků, nebo teoretických škol na univerzalitu lidských práv. Začínám klasickým stanoviskem kulturního relativismu, poté představuji další relativizující autory, autory pragmatických přístupů, na ty postupně navazuji koncepty, které více či méně argumentují ve prospěch univerzality. Jednou ze zlomových myšlenek v tomto směru je idea překrývajícího se konsensu, jejímž autorem je slavný, americký filosof John Rawls. Nakonec rozebírám přístup jednoho z nejvlivnějších teoretiků lidských práv posledních třiceti let, kterým je Jack Donnelly. Zbylou část práce věnuji vlastní úvahám na téma univerzality a legitimity lidských práv v dnešní době a reflexi současné debaty.Topic of this thesis is mainly the universality of human rights and various attempts at its non-metaphysical defense, i.e. justificatory theories. In the first part I present primarily the classification of such theories by Robert Alexy. In the second chapter I analyze the views of individual theorists on the universality of human rights. I start with classic attitude of cultural relativism, then I introduce other relativizing authors, authors of pragmatic approaches, which are gradually followed by concepts that more or less argue in favor of universality. One of the groundbreaking ideas in this regard is the Idea of an overlapping consensus formulated by famous American philosopher John Rawls. Finally, I analyze the approach of one of the most influential human rights theorists of the last thirty years, Jack Donnelly. The rest of the work is devoted to my own reflections on the subject of universality and legitimacy of human rights nowadays and reflection of the current debate.
