Tato diplomová práce pojednává o nutné obraně a krajní nouzi jako okolnosti vylučující protiprávnost se zaměřením na vymezení podmínek nutné obrany a krajní nouze a zda - li jsou tyto podmínky přísné pro ty, co takto jednají a jestli dostatečně zohledňují psychické rozpoložení osoby, která jedná v rámci nutné obrany a krajní nouze.V úvodní kapitole jsou rozebrány ostatní okolnosti vylučující protiprávnost podle trestního zákoníku. Dále se práce zaměřuje na vymezení podmínek nutné obrany a krajní nouze včetně kapitoly, která se snaží stručně vymezit rozdíly mezi těmito okolnostmi vylučující protiprávnost. Poté přichází klíčová část této práce, a to problematika vybočení z mezí nutné obrany a krajní nouze včetně vymezení automatických obranných zařízení. V poslední části se práce zabývá právními důsledky vybočení z mezí nutné obrany a krajní nouze.This thesis deals with the necessary defense and extreme distress as circumstances excluding illegality with a focus on defining the conditions of necessary defense and extreme emergency and whether these conditions are strict for those who do so and if they sufficiently take into account the mental state of the person acting within necessary defense and extreme emergency.In the introductory chapter, other circumstances excluding illegality under the Criminal Code are discussed. Furthermore, the work focuses on defining the conditions of necessary defense and extreme distress, including a chapter that tries to briefly define the differences between these circumstances excluding illegality. Then comes the key part of this work, namely the issue of deflection from the limits of necessary defense and extreme emergency, including the definition of automatic defense equipment. In the last part the thesis deals with the legal consequences of the deviation from the limits of necessary defense and extreme emergency.
