Diplomová práce se zabývá problematikou schopnosti dítěte samo se živit pro účely přiznání výživného. V první části jsou rozebrány podmínky vzniku vyživovací povinnosti rodičů k dětem. Dále je práce zaměřena na rozsah vyživovací povinnosti a jednotlivá kritéria, která musí soud zkoumat při určování výše výživného. Hlavním tématem práce je posouzení majetkových poměrů, studia a zdravotního stavu dítěte a jejich vlivu na schopnost dítěte samo se živit. Nedílnou součástí práce je i přiblížení rozhodovací praxe soudů v oblasti vyživovací povinnosti rodičů k dětem. Judikatura je důležitou součástí při rozhodování soudů, protože právní úprava obsahuje pouze obecná kritéria pro určování výše výživného.The diploma thesis deals with the issue of the child´s ability to support himself for the purposes of maintenance. The first part discusses the conditions of parents´ maintenance obligation to children. Furthermore, the work focuses on the extent of maintenance obligations and individual criteria that the court must examine when determining the amount of maintenance. The main topic of the thesis is to assess the property situation, study and health condition of the child and their influence on the child´s ability to support himself. An integral part of the thesis is also approaching the decision-making practice of courts in the area of parents´ maintenance obligations to children. The case law is an important part in the decision-making of courts, since the legislation contains only general criteria for determining the amount of maintenance.
