Tato diplomová práce se věnuje aktuálním otázkám ve vypořádání společného jmění manželů. Autorka v ní rozebírá institut jako takový, jak funguje, jakými zásadami je ovládán a jakými prošel změnami s ohledem změnu právní úpravy v posledních letech. Práci autorka rozčlenila do čtyř kapitol. V první kapitole autorka vysvětluje a uvádí pojem SJM, co si pod ním představit, co je jeho součástí, jaký je jeho rozsah a srovnává ho s úpravou německého práva. Druhá kapitola práce vysvětluje možnosti zániku, zúžení a zrušení SJM, které jsou nutné k pochopení institutu vypořádání, který představuje obsah třetí kapitoly. Vypořádání SJM tvoří hlavní důraz této práce, a to společně s poslední čtvrtou kapitolou, která je jistým shrnutím těch nejdůležitějších a nejzajímavějších změn v nové úpravě dle OZ oproti úpravě staré v OZ 1964. Autorka by dále svou prací ráda přispěla k prevenci různých omylů, jež panují ohledně SJM a to zejména v oblasti, co vše je obsahem SJM, otázka velikosti podílů atd.This thesis deals with the current questions regarding the dissolution of the community property. The author analyses the institute as such, how does it work, which principles control it and which changes made an impact on it throughout the last years. The author divided the thesis into four chapters. In the first chapter, the author defines and explaines the institute of the community property, what does it mean, what is its scope, what is related to it and she compares it with the institute of community property in Germany. The second chapter explains the possibilites of a termination, restriction and enlargement of the community property, which is crucial in order to understand the institute of the dissolution of community property, which represents the content of the third chapter. The dissolution of the community property is the main focus of this thesis, together with the chapter four, which forms a summary of the most important and interesting alternations of the new legislation in comparison to the old one. The author would like to contribute through her work to the prevention of certain errors, which reign about the community property, especially concerning the scope of the community property, the size of shares etc.
