Diplomová práce se zabývá udělováním povolení v oblasti hazardu. Právní úprava hazardních her prošla velkou změnou přijetím nového herního zákona. Úkolem práce bylo analyzovat podmínky nutné pro získání povolení k provozování hazardních her a porovnat jejich změnu oproti předchozí právní úpravě. V úvodu práce je obsažena obecná charakteristika povolení jako jedné z forem činnosti veřejné správy a rozdělení kompetencí orgánů veřejné správy v oblasti hazardních her s důrazem na úlohu obcí při udělování povolení. Podrobněji pak diplomová práce popisuje definici hazardní hry, její druhy a některé další pojmy použité v práci. Stěžejní kapitola pojednává o jednotlivých podmínkách, které jsou po žadateli o povolení k provozování hazardních her vyžadovány. V závěru práce je kapitola věnovaná obecně závazným vyhláškám obcí, jež jsou významným prostředkem regulace hazardních her a předmětem rozhodovací činnosti Ústavního soudu a Nejvyššího správního soudu. Poslední kapitola se týká problematiky provozování hazardních her prostřednictvím internetu. Význam tohoto odvětví hazardního hraní postupem času roste a nová legislativa se s tím musela vypořádat.The thesis deals with the granting an authorization in the area of gambling. The legislation related to the gamble has changed a lot due to the acceptance of the new game law. The task of the thesis was to analyze the necessary conditions for obtaining the authorization to carry on the gamble and compare their change against the previous legislation. The intoduction of the thesis contains the general characteristics of an authorization as one of the forms of public administration activity and the competencies distribution of the public administration authorities with emphasis on the role of the municipalities. In more detail, the thesis describes the definition of the gamble, its types and some other concepts used in the thesis. The key chapter deals with the particular conditions, which are required by the applicant for the authorization to carry on the gamble. At the end of the thesis there is the chapter dedicated to the generally binding decrees, which are the significant instrument of the gamble regulation and the subject of the decision-making activities of the the Czech Constitutional Court and the Supreme Administrative Court. The last chapter relates to the problematics of the gamble activities via the Internet. The importance of this gambling branch is growing in the course of time and the new legislation had to deal with it.
