Práce se zabývá problematikou ochrany hypotetického vypořádacího podílu při postižení společného jmění manželů v exekuci, a to s ohledem na nedávnou harmonizaci hmotné i procesní úpravy soukromého práva provedenou zejména zákonem č. 89/2012 Sb., občanský zákoník, ve znění pozdějších předpisů, a novelou č. 139/2015 Sb., která do právní úpravy postavení nedlužného manžela výrazně zasáhla. Cílem je posouzení možností postižení SJM v exekuci, postavení manžela povinného v exekučním řízení a zhodnocení efektivity právních prostředků chránících manžela povinného v exekučním řízení.The thesis focuses on protection of the hypothetical settlement share of the spouse of obliged person in the affection of the community property of the spouses by distraint, in view of the recent harmonization of the substantive and procedural regulation of private law implemented in particulary by Act No. 89/2012 Coll., The Civil Code, and by the Amendment No. 139/2015 Coll., which significantly affected the regulation of the status of the spouse of obliged person. The aim is to assess the possibility of affection of the community property of the spouses by distraint, the status of the spouse of obliged person by distraint, and the evaluation of effectiveness of the legal means protecting the spouse of the obliged person in distraint.
