Diplomová práce se zabývá právním základem a následnou obhajobou otroctví a rasové segregace ve Spojených státech amerických. Úvodní kapitola se věnuje problematice vědeckého rasismu a vědeckých teorií. Druhá kapitola je stěžejní část práce, kde je nastíněna historie otroctví a rasové segregace od vzniku Spojených států amerických až do dnes. Obsahuje přehled historických událostí a jejich vliv na přijímání právních předpisů. Ve druhé kapitole jsou hojně obsaženy příklady zákonů a soudní judikatury. Třetí, závěrečná kapitola, se věnuje nacistické rasové segregaci a jejímu právnímu základu. Obsahuje přehled historických událostí v letech 1933-1945 a krátce se věnuje obhajobě německého antisemitismu u Norimberského procesu. V celé práci je kladen důraz na judikaturní činnost Nejvyššího soudu USA a jeho vliv na výklad Ústavy Spojených států amerických a zákonů.This diploma thesis deals with legal bases and the following arguments for slavery and racial segregation in the United States of America. The first chapter of this thesis deals with the issue of scientific racism and their theories. In the second chapter, which is the main part of my work, is outlined the history of slavery and the racial segregation since the beginning of the United States. This chapter contains the overview of historical events and their influence on the legislation. In the second chapter, there is planty of examples of Acts and the decisions of US Supreme court. The final chapter is dedicated to Nazi racial segregation and its legal bases. It contains the overview of historical events between 1933 and 1945 and briefly it deals with German anti- Semitism during the Nuremberg trial. Through the whole thesis, I focus on case law of the US Supreme Court and its effect on the interpretation of American constitution and laws
