Tato bakalářská práce se zabývá charakteristikou Bitcoinu z pohledu českého právního řádu. V první části práce je vymezena základní charakteristika Bitcoinu, dále je zde nastíněn stručný vývoj Bitcoinu a rovněž i základní charakteristické vlastnosti Bitcoinu. Další část se zabývá právě problematikou, zda lze Bitcoin chápat jako měnu či peníze. V této části jsou vymezeny pojmy měna a peníze, a zároveň i funkce které daný institut ze své podstaty plní. V této kapitole je Bitcoin právě s těmito instituty porovnáván, respektive zjišťován stav, zda je Bitcoin způsobilý plnit určité funkce buď měny či peněz a na základě těchto zjištění učiněn závěr, zda je možné Bitcoin pod jeden z těchto institutů podřadit. Poslední část se zaměřuje na další případné pojmy, pod které by bylo možné Bitcoin podřadit, a zároveň tato část shrnuje různé úhly pohledů vybraných států na danou problematiku.This bachelor thesis deals with the characteristics of Bitcoin from the point of view of the Czech laws. The first part of the thesis defines the basic characteristics of Bitcoin, briefly describes the development of Bitcoin as well as its main attributes. Another part of my bachelor thesis is focused on the question of whether Bitcoin can be understood as currency or money. The concepts of currency and money, as well as the functions that the institute by its nature should fulfil, are defined in this part. This chapter also compares Bitcoin with these institutes, and whether Bitcoin is able to perform certain functions of either currency or money. In the end of this section, there is my conclusion of whether or not the Bitcoin can be subordinated to one of these institutes. The last part focuses on other possible concepts under which Bitcoin could be subordinated. This section summarizes the various approaches of selected states on the given issue.
