Tato práce se zabývá vývojem postavení polského prezidenta v období vlády Lecha Wałęsy a Aleksandra Kwaśniewského v období let 1990 až 2005. Hlavním cílem práce bylo zjištění, v čem se liší postavení prezidenta Polské republiky podle tzv. malé ústavy z roku 1992 a Ústavy Polské republiky z roku 1997. Byla zde věnována pozornost na využívání ústavních pravomocí a jejich možného zneužívání ve vlastní prospěch. Ke zkoumání byla použita analýza na základě teorie Shugarta a Carey, jenž byla později upravena Lee Metcalf, a jejich kvantifikaci prezidentských pravomocí, které poskytují nástroj pro srovnání prezidentských pravomocí. Ve zkoumaném případě se jedná o dva ústavní dokumenty tzv. malou ústavu z roku 1992 a "řádnou" ústavu, tj. Ústavu Polské republiky z roku 1997. Na základě komparací jednotlivých prezidentů jsem zjistila minimální rozdíly v rámci ústavy, ale velké rozdíly v reálném fungování politiky, resp. působení hlav státu v politické praxi. V rámci zkoumání jsem došla k závěru, že postavení polského prezidenta se odvíjí od situace na domácí politické scéně a jeho vztahů s vládou a parlamentní většinou. Z pozorování pravomocí Lecha Wałęsy dle malé ústavy a Aleksandra Kwaśniewského dle ústavy z roku 1997 vyplývá, že mezi formálním postavením obou hlav státu neexistuje výraznější rozdíl. Výsledné postavení prezidenta v politickém systému je odvozeno od vztahů mezi prezidentem, vládou či parlamentem a politikou a kroky, kterými prezident narušuje ústavní vymezení jeho pravomocí.This bachelor´s thesis deals with development of the position of the Polish presidents Lech Wałęsa and Aleksander Kwaśniewski in Polish political system between 1990 and 2005. The main object of the thesis is to how differ the position of the President of the Republic of Poland differs according to the so-called Small Constitution of 1992 and the Constitution of the Republic of Poland of 1997. The thesis focuses on the use of constitutional powers and their possible abuse for their own benefit.The analysis was based on the theory of Shugart and Carey, which was later modified by Lee Metcalf, and their quantification of presidential powers, which provides a tool for comparing of presidential powers. In the case under consideration,these are two constitutional documents so-called Small Constitution of 1992 and "regular" Constitution of the republic of Poland from 1997. Based on the comparisons of the individual presidents, we found minimal differences within the constitution, but big differences in the real functioning policy, respectively the influence of the heads of state in political practice. As part of our investigation, we have come to the conclusion that the position of the Polish president depends on the situation, on the internal political scene. From the observation of Lech Wałęsa´s authority, according to a small constitution and Aleksander Kwaśniewski, and to the 1997 Constitution, there is no significant difference between the formal statuses of both heads of states. The resulting position of the president in the political system is derived from relations between president, government or parliament, and the policies and actions by which the president undermines the constitutional delimitation of his powers.
