    Diplomová práce pojednává o právním postavení putativního otce v českém právním řádu. Práce analyzuje možnosti, které český právní řád dává putativnímu otci za účelem sladění jeho biologického a právního otcovství. Cílem práce je dále zjistit, zda je česká právní úprava v souladu s judikaturou Evropského soudu pro lidská práva. Diplomová práce se skládá ze šesti kapitol. První kapitola teoreticky vymezuje základní pojmy biologické, sociální a právní otcovství a také ústřední pojem práce putativní otec. Druhá kapitola mapuje práva putativního otce a dítěte zaručená Úmluvou o ochraně základních práv a svobod a Úmluvou o právech dítěte. Na třetí kapitolu, která je věnována současné právní úpravě určování otcovství, bezprostředně navazuje kapitola čtvrtá, zabývající se popíráním otcovství. Obě kapitoly vymezují zejména postavení putativního otce v těchto úpravách. Pátá kapitola obsahuje analýzu judikatury Evropského soudu pro lidská práva a nejnovějšího nálezu Ústavního soudu týkající se problematiky práv putativních otců. Šestá kapitola popisuje možnost práva na styk putativního otce s dítětem.The thesis deals with the legal status of the putative father in the Czech legal order. The thesis analyses the possibilities which putative father has in order to reconcile his biological and legal paternity. The aim of the thesis is also to find out whether the Czech legislation is in agreement with the case law of the European Court of Human Rights. The thesis consists of six chapters. The first chapter theoretically defines the basic terms such as biological, social and legal paternity and also the principal term of the thesis a putative father. The second chapter maps the rights of the putative father and child, which are guaranteed by the European Convention on Human Rights and Convention on the Rights of the Child. The third chapter which is devoted to the current legislation of the determination of paternity is immediately followed by the fourth chapter which is concerned with the denial of paternity. Both chapters define the position of the putative father in legislation. The fifth chapter contains an analysis of the case law of the European Court of Human Rights and the latest decision of the Constitutional Court concerning with the rights of putative fathers. The sixth chapter describes the possibility of the right to contact of the putative father with a child.
