Tato diplomová práce s názvem Současné využívání mediace z pohledu zapsaných mediátorů se zabývá mediací jako jednou z možností řešení sporů, přičemž je kladen důraz především na praktickou stránku. Nejprve se mediací zabýváme z teoretického pohledu. Definujeme pojem mediace, zaměřujeme se na různé aspekty jejího uplatňování a také oblasti jejího využití. Druhá kapitole se věnuje právní úpravě mediace v České republice, jejímu vývoji až po současnost. Obsahem třetí kapitoly je osoba zapsaného mediátora, podmínky výkonu jeho činnosti, jeho práva a povinnosti a také osobnostní předpoklady. Čtvrtá kapitola nás seznamuje, s jakými formami výkonu mediaci se u nás můžeme setkat. Pátá kapitola je ta nejpodstatnější a tvoří ji empirická část, ve které budeme pracovat s daty sesbíranými z dotazníkového šetření, jehož respondenti jsou zapsaní mediátoři. V této části práce byly ověřeny závěry z teoretické části práce a zjištěn pohled zapsaných mediátorů na aktuální stav mediace u nás. Cílem práce byla identifikace a analýza problematických oblastí současného využívání mediace z pohledu zapsaných mediátorů.This thesis entitled Current use of mediation from the perspective of registered mediators focuses on mediation as one of the possibilities of dispute resolution with an emphasis on its practical aspects. Firstly, mediation is explained from a theoretical point of view. We define the concept of mediation, we focus on various aspects of its application and the area of its use. The second chapter deals with legal regulation of mediation in the Czech Republic, its development to the present. The content of the third chapter is the person of a registered mediator, the conditions of performing his activity, his rights and duties, as well as his personality assumptions. The fourth chapter introduces the forms of mediation we can meet with us. The fifth chapter is the most important and forms an empirical part in which we will work with data collected from the questionnaire survey, whose respondents are registered mediators. In this part of the thesis the conclusions from the theoretical part of the thesis were verified and the view of registered mediators on the current state of mediation in our country was found. The aim of the thesis was to identify and analyze problematic areas of the current use of mediation from the perspective of registered mediators.
