Cílem diplomové práce je zhodnocení institutu náhradního mateřství a právních důsledků mlčení zákona se zaměřením na určování statusových práv takto narozeného dítěte a na jeho právo znát svůj původ. Práce je strukturovaná do pěti kapitol, přičemž v první kapitole jsou vysvětleny základní pojmy pojící se s institutem náhradního mateřství. Druhá kapitola se zabývá právní úpravou náhradního mateřství v České republice. Určování statusových práv je popsáno ve třetí kapitole. Čtvrtá kapitola se zaměřuje na surogátní smlouvu a pátá kapitola se zabývá právem dítěte znát svůj původ.The aim of this thesis is to appraisal of the institute of surrogacy and legal consequences of the lack of legislation with main focus on the determination of family status of children born through surrogacy. The diploma thesis is composed out of five chapters, the first chapter deals with basic terms related to surrogate motherhood. The second chapter is focused on Czech Republic´s legislation. Proces of determination of family status is described in the chapter three. The fourth chapter is focused on surrogacy agreement and the fifth chapter deals with the children´s right to know their origin.
