Tématem této bakalářské práce je "Problematika ztráty mandátu v zastupitelských orgánech ČR". Cílem práce je seznámit čtenáře se současnou právní úpravou důvodů zániku mandátu členů zastupitelských orgánů ČR. Obsahem první kapitoly je současná právní úprava zániku mandátu u poslanců a senátorů Parl. ČR a novela Úst. ČR vztahující se k této problematice. Další kapitola této práce se zaměřuje na zánik mandátu poslance a senátora před rokem 1989 a jeho komparaci se současnou právní úpravou zániku mandátu zákonodárce. Obsahem třetí kapitoly je současná právní úprava zániku mandátu člena zastupitelstva obce a kraje, starosty (primátora) a hejtmana. V závěru práce je předkládána vybraná judikatura ÚS, jejímž předmětem je zánik mandátu člena zastupitelstva obce. Hlavním cílem práce je zodpovědět výzkumné otázky a dílčí výzkumné otázky položené v úvodu této práce.The theme of this thesis is "The issue on the Loss of Mandate in Representative bodies in the Czech Republic." The objective is to familiarize the reader with the current legislation of causes of termination of the mandate of members of representative bodies of the Czech Republic. The first chapter summarises the current legislation detailing loss of mandate of MPs and senators of the Parliament of the Czech Republic and the relevant amendment of the Constitution of the Czech Republic. The following chapter of this thesis focuses on the termination of the mandate of MP and senator before 1989 and its comparison with the current legislation re termination of the mandate of the legislator. The third chapter is the current legislation detailing the loss of mandate of a member of the municipal council, member of the county council, the mayor and the district council governor. In the conclusion of the thesis, a selected jurisprudence of the Constitutional Court is presented, the object of which is the loss of mandate of a member of the municipal council. The main objective of the thesis is to answer the research questions and partial research questions posed in the introduction to this work.
