Práce se zabývá problematikou regulace hazardních her, které jsou v rámci EU považovány za specifickou službu a jsou tedy součástí jednotného vnitřního trhu EU. Z důvodu zvláštní povahy hazardu ponechává EU členským státům prostor pro právní úpravu, která zohledňuje jejich individuální hodnoty, a zároveň musí být v souladu právem EU. Práce popisuje propojení hazardních her s jednotlivými svobodami jednotného vnitřního trhu, analyzuje právní úpravu EU, která se dotýká regulace hazardu v rámci jednotného vnitřního trhu a zkoumá dopady těchto ustanovení EU na právní řád ČR. V návaznosti na to práce analyzuje stávající zákon č. 202/1990 Sb., o loteriích a jiných podobných hrách, který je v rozporu s právem EU a dále zákon č. 186/2016 Sb., o hazardních hrách, který má rozpor odstranit.The thesis deals with the regulation of gambling that is considered specific service in the EU therefore it is a part of the unified single market of the EU. The EU lets its member states to keep their space for the legal regulation because of the specific nature of gambling. This regulation reflects member states' individual values and it has to be in compliance with the legal system of the EU. The thesis describes a connection between gambling and freedom of the unified single market, analyzes the legislation of the EU which affects regulation of gambling in unified single market and examines consequences of these EU legislations for the Czech legal norm. Later, the thesis deals with the current law no. 202/1990 of the statute book, concerned with lotteries and other similar games which is not in compliance with the EU legal system and with the law No. 186/2016 of the statute book, concerning gambling, that should eliminate the contradiction.
