It is a relevant contemporary theme, when even the society demands every individual to have a father except just a mother. The first chapter of the thesis is focused on the paternity of the mother´s spouse determined by law, determination of the mother´s spouse in the case of artificial insemination and also solving the situation determination of the paternity to a child, whose mother remarried, when the law prefers the paternity to her subsequent husband. The second chapter is concentrated on adjusting the conversion of the first presumption of the paternity in favor of the second, where the mother, the spouse or the former spouse of the mother and the man who claims to be the child´s father make an affirmative declaration for the determination the child´s father together. The chapter which is dedicated to the denial of the mother´s husband is concentrated on the course of the denial´s periods and court may decide that the elapsed time limit is waived if required by the child's interest and public order. The final chapter concentrates on the interest of the child, which pervades the whole process of determination and denial of the paternity.
