Diplomová práce se zabývá tématem svěřenského nástupnictví a jeho úpravou v občanském zákoníku účinném od 1.1.2014. Kromě analýzy tohoto institutu je část práce věnována srovnání s inspiračními zdroji (občanský zákoník Spolkové republiky Německo a Obecný zákoník občanský). Komparace je zaměřena na srovnání rozsahu a úspěšnosti převzetí úpravy svěřenského nástupnictví z inspiračních zdrojů do občanského zákoníku. Mimo srovnání s občanským zákoníkem Spolkové republiky Německo a Obecným zákoníkem občanským se práce zabývá také úpravou svěřenského nástupnictví v občanském zákoníku Republiky Rakousko - ABGB, kdy nastiňuje možný vývoj tohoto institutu v našem právním řádu dle vývoje v právním řádu Republiky Rakousko.The thesis deals with the regulation of the Trust Succession in Civil Code which is effective from 1.1.2014. Besides the analysis of this institute the one part of thesis is dedicated to comparison with the inspirational sources (Civil Code of Federal Republic of Germany and General Civil Code). The comparison is concentrated on comparison of the extend and the success rate of receipt of adaptation the Trust Succession from the inspirational sources to Civil Code. Besides the comparison with Civil Code of Federal Republic of Germany and General Civil Code the thesis also deals with the adaptation of the Trust Succession in Civil Code of Republic of Austria - ABGB, when the thesis outlines probable development of this institute in our legal system according to the outlines of this institute in legal system of Republic of Austria.
