Diplomová práce se zabývá společenstvím vlastníků jednotek podle ObčZ. V místech k tomu vhodných je tato právní úprava komparována s právní úpravou předchozí, tedy s úpravou obsaženou v ZoVB. Zvláštní pozornost věnuji těm institutům společenství, které jsou zcela nové, popř. podstatně přepracované. Např. fakultativní založení společenství, hlasování per rollam, neplatnost rozhodnutí orgánů SVJ či předpoklady pro výkon funkce ve statutárním orgánu. Důraz je také kladen na problematické aspekty právní úpravy de lege lata ve vztahu k praktickému fungování společenství. V neposlední řadě je celá problematika SVJ vymezena z širšího pohledu tzv. bytového práva.The diploma thesis deals with the owners association regulated by the Civil Code. This legislation is compared in suitable places with previous legislation, i.e. the regulation contained in the Flat Ownership Act. I pay special attention to those institutes of the owners association which are completely new or substantially revised. E.g. facultative establishment of the owners association, distance voting, invalidity of decision of the owners association´s authorities or requirements for the discharge of office in a statutory body. Emphasis is also placed on the problematic aspects of law de lege lata in relation to the practical functioning of the owners association. Finally, the whole issue of the owners association is defined from the perspective of the broader housing law.
