Problematika rozvodu s nezletilými dětmi je v současnosti tématem velmi aktuálním. Jelikož je nezletilé dítě osoba zranitelná, vyžadující zvýšenou ochranu, lze klást na zákonodárce rovněž vysoké nároky, pokud jde o kvalitu právní úpravy dané oblasti. Hlavním cílem této práce je prověřit, zda český právní řád poskytuje dostatečné záruky toho, že se v každém jednotlivém případě podaří nalézt řešení, které bude odpovídat zájmu nezletilého dítěte. Tento cíl se autorka snažila naplnit ve dvou hlavních kapitolách. První z nich se zaměřuje výhradně na rozbor právní úpravy rozvodu, druhá poté přibližuje problematiku úpravy poměrů nezletilého dítěte pro dobu po rozvodu. Autorka se v průběhu psaní celé práce snažila podrobovat předmětnou materii kritickému pohledu a upozorňovat na případné problémy a možnosti jejich řešení. Celou prací se významným způsobem prolíná především použití historické metody, když autorka často poukazuje na rozdíly mezi právní úpravou obsaženou v předchozím ZoR a současnou úpravou v NOZ. Za účelem komplexního zpracování tématu autorka rovněž v rámci celé práce cituje relevantní judikaturu. S ohledem na omezený rozsah práce nebylo možno postihnout předmětnou oblast ve všech podrobnostech. Chybí tak např. pojednání o psychologických aspektech, které jsou s tematikou rozvodu s nezletilými dětmi velmi úzce spojeny, např. o syndromu zavrženého rodiče. Určité dílčí oblasti bylo nutno pojmout stručněji. I přesto se však autorka domnívá, že problematika byla zpracována dostačujícím a zajímavým způsobem a že práce odpovídá úrovni, která se od diplomové práce očekává.The issue of divorce with minor children is currently very live topic. Since the minor child is a vulnerable person, requiring extra protection, high demands in terms of quality of regulations should be required from the legislature too. The main objective of this thesis is to investigate whether the Czech legislation provides sufficient guarantees that in each individual case a solution can be found that would fit the interests of a minor child. The authoress tried to accomplish this objective in two main chapters. The first chapter focuses solely on the analysis of the divorce legislation, the other one describes the issue of adjusting the circumstances of the minor child after the divorce. In the whole thesis, the authoress tried to subject its subject matter to critical review and to highlight possible problems and solutions. The whole thesis is significantly affected by the use of historical comparison, when the authoress often points out the differences between the legal regulations contained in the previous family law and current legal regulations in the New Civil Code. To process the topic comprehensively, the authoress also cites relevant judicial decisions throughout the thesis. Given the limited scope of the thesis it was not possible to capture the subject area in every detail. For instance, treatises on psychological aspects that are very closely linked to the topic of divorce with minor children are missing, e.g. the parental alienation syndrome. However, it was necessary to hold certain areas more briefly. Anyway, the authoress still believes that the issue was handled in a sufficient, interesting way and that her thesis corresponds to a level, which is expected from a diploma thesis.
