Cílem této diplomové práce, jejímž tématem jsou trestné činy proti lidské důstojnosti v sexuální oblasti, je co nejpodrobněji vymezit dva nejčastěji páchané trestné činy z této oblasti. Dále se zabývá postavením obětí trestných činů, zvláště v souvislosti s novou právní úpravou. Důraz je kladen na interpretaci pojmů skutkových podstat, které v praxi mohou činit potíže, zhodnocení stávající úpravy a náměty na možnosti pozměnění. Opomenuta nezůstala ani úprava vybraných trestných činů na evropské úrovni. Úvodní kapitola je věnována trestnému činu znásilnění. Její součástí je stručný vývoj tohoto trestného činu, znaky skutkové podstaty, charakteristika osoby pachatele, sankcionování a statistické údaje. Následující kapitola pojednává o trestném činu pohlavního zneužití a je vystavěna obdobně jako kapitola úvodní. Jak trestný čin znásilnění, tak trestný čin jsou porovnány s trestným činem sexuálního nátlaku. Závěrečná část této diplomové práce se zabývá oběťmi sexuálně motivovaných trestných činů. Obsahuje charakteristiku a vymezení obětí, procesní práva i praktické zásady, které by orgány činné v trestním řízení měly ve styku s obětí dodržovat.The aim of this diploma thesis, which theme are criminal offenses against the human dignity in the sexual area, is desciption of the two most frequently committed crimes in this area. It also deals with the role of the victims of criminal offenses, patricularly in relation to the new legislation. Emphasis is placed on the interpretation of the term of facts of the case, which can cause problems in practice, evaluation of existing regulations and suggestions for it's modifying. The thesis also includes regulations of selected criminal offenses at European level. The introductory chapter is devoted to the crime of rape. It includes a brief development of this crime, features of the facts of the case, characteristics of the perpetrator, sanctioning and statistical data. The following chapter deals with the criminal offence of sexual abuse and the chapter is built like the introductory chapter. The crime of rape and crime of sexual abuse are compared with the crime of sexual coercion. The final part of this thesis deals with victims of sexual offenses. It contains a characterictic and definition of victims, procedural laws and practical principles that the authorities in the criminal proceedings should be, in the contact with the victim, abide.
