Diplomová práce se zaměřuje na ochranu života, jakožto nejcennější hodnoty ve společnosti, v trestním právu, přičemž detailně zkoumá dvě skutkové podstaty a to trestný čin zabití a trestný čin vraždy novorozeného dítěte matkou. V rámci jejich analýzy se práce zaměřuje na faktor rozrušení, který je typický pro obě výše uvedené skutkové podstaty. Následně prověřuje, zdali rozrušení představuje opravdu natolik významný prvek, že díky němu jsou pachatele těchto trestných činů trestáni mírněji i přes to, že v obou případech jde o formy úmyslného usmrcení. Práce je dělena do tří částí. V první části se věnuje zakotvení ochrany života a zdraví v mezinárodních dokumentech a poté se soustřeďuje na vnitrostátní právní úpravu. Dále pak již konkrétně vymezuje počátek a konec života z hlediska trestního práva. Právě s koncem života se pojí i problematika euthanasie. Ta je tedy blíže rozebrána. Je zde obsažen historický exkurz, dále pojmy, které vedou k bližšímu objasnění problematiky. Zkoumá legalizaci euthanasie v zahraničí, kde uvádí příklady různých zemí a také nastiňuje postoj České republiky k euthanasii. Druhá část je věnována trestným činům proti životu, kde je stěžejním tématem již zmíněný popis trestných činů zabití a vraždy novorozeného dítěte matkou. Třetí část se zabývá komparací právní úpravy ochrany života a zdraví na SlovenskuThis thesis focuses on the protection of life (as it is the most precious value in society) in criminal law, while it examines in detail two crimes: homicide and murder of a newborn child by its mother (this could be also called infanticide). It also focuses on the agitation factor, which is typical for both crimes and it ascertain whether agitation represents such an important element, that person who commits one of these crimes is being punished more moderately , even though in both cases it is a form of intentional killing. Thesis is divided into three parts. The first part shows the protection of life and health in the international documents and it also concentrates on national legislation. Further it defines the beginning of life and also the end of life from the view of criminal law. The end of life is linked to the issue of Euthanasia. Therefore it is closer described. It includes historical excursion, as well as concepts that lead to a more detailed explanation of the issue. It examines legalization of Euthanasia abroad and also outlines the position of the Czech republic to Euthanasia. The second part is devoted to crimes against life, where the main issue is the aforementioned description of the crimes of homicide and murder of a newborn child by its mother. The third part deals with the comparison of protection of life and health in Slovak criminal law.
