Cílem práce je poukázat na problematické body mezi bilaterálními smlouvami o ochraně investic (BIT) a právem EU. Bilaterální smlouvy o ochraně investic slouží především pro zajištění přílivu zahraničních investic do hostitelských států. V rámci práce budou analyzovány některé BIT, které byly uzavřeny mezi ČR a dalšími státy např. Nizozemí či USA.Velkým předělem pro oblast pravomocí EU v otázce investic bylo přijetí Lisabonské smlouvy. Proto se budu snažit v práci odpovědět na otázku, jakým způsobem ovlivnilo přijetí této smlouvy vnímání BIT v rámci práva EU. Zároveň práce operuje s hypotézou, která zohledňuje výše zmíněná fakta a zní: Rozpory meziprávem EU a mezinárodněprávními závazky členských států v oblasti ochrany investic mají vliv na status BIT. Hypotéza vychází z přesvědčení, že vzrůstající vliv EU v oblasti investic po přijetí Lisabonské smlouvy vede k vyššímu tlaku na regulaci BIT ze strany Komise. Tento faktor je posilován i členskými státy, pro které se již BIT kvůli finančním kompenzacím v rámci investičních arbitráží stávají nevýhodné.The aim of my thesis is to point out the problematic issues that arise between the bilateral investment treaties (BIT) (billateral Investment Treaties) and the EU law. Bilateral investment treaties secure the inflow of foreign investment into host countries. Some of the BITs will be analysed which were signed by the Czech Republic and other countries such as the Netherlands and USA. A major turning point for the competence of the EU in the field of investment was the adoption of Lisbon Treaty. Therefore I will try answer the question of how the adoption of this treaty affected the perception of BIT from the point of view of the EU law. At the same time the thesis deals with with the hypothesis which takes into account the above mentioned facts and it is called: Discrepancies between the EU law and the international legal obligations of Member States in the field of investment protection affect the status of BIT.The hypothesis is based on the belief that the growing influence of the EU in the field of investment after the adoption of Lisbon Treaty leads to greater pressureby the Commission to control BIT. This is supported by Member States for which BIT are becoming disadvantageous due to financial compensations which are part of investment arbitrations.
