Diplomová práce se zabývá prolínáním témat trestu smrti a trestu odnětí svobody na doživotí z historického hlediska v Českých zemích. První kapitola pojednává o základních pojmech a o začlenění do mezinárodního kontextu. Následuje druhá část zabývající se argumenty pro a proti trestu smrti podpořená názory některých dnešních osobností. V další kapitole je rozpracována historie obou institutů v Českých zemích. Zaměřuje se především na období od osvícenství do současné doby. Zachycuje postupný vznik trestu odnětí svobody na doživotí a jeho následný vývoj a zároveň útlum ukládání trestu smrti. Uveden je i vznik známé gilotiny. Poslední kapitola analyzuje názory významných osobností české právní vědy na trest smrti, kde se osobnosti často vyjadřují i k jeho náhradě trestem doživotí. Jedná se především o postoje Jaroslava Kallaba, Vladimíra Kubeše či Augusta Miřičku.This diploma thesis deals with blending of the themes of the death penalty and imprisonment for life from a historical perspective in the Czech lands. The first chapter covers the basic concepts and the integration into the international context. The following part deals with arguments for and against death penalty, which is supported by the opinions of some of the today's figures. The next chapter elaborates the history of both institutions in Czech lands. It focuses primarily on the period from Enlightenment to present time. It captures the gradual emergence of the sentence of life imprisonment and his subsequent development, as well as the attenuation of the death penalty. There is also listed the creation of the famous guillotine. The last chapter analyzes the opinions of prominent personalities of Czech jurisprudence on the death penalty, where they often discuss its replacement with the life imprisonment. These are the attitudes of people like Jaroslav Kallab, Vladimír Kubeš or August Miřička.
