Tato práce pojednává o morálních aspektech náhrady škody jako o vztahu, který vzniká mezi poškozeným a škůdcem. Jelikož je institut náhrady škody nelze oddělit od pojmu spravedlnosti a práva, se kterým je velmi těsně spojen, obsahuje práce poměrně široce rozvinuté téma spravedlnosti a práva, tak jak se rozvíjelo v historickém kontextu. Zvláštní pozornost je věnována rozvoji úvah o právu, spravedlnosti a náhradě škody v období řecké klasické filozofie, ale především biblickému pojetí s důrazem na změnu chápání významu těchto pojmů v Novém zákoně oproti Zákonu starému. Se stejným zájmem si práce všímá i soudobých teorií spravedlnosti z hlediska teologicko-etického, přičemž ve středu zájmu se ocitá spravedlnost směnná (komutativní). V rámci pojednání o spravedlnosti jako o kardinální ctnosti je úkon náhrady posuzován ve světle mravních a etických principů včetně některých provinění proti nim. Nechybí ani praktická doporučení křesťanům při uplatňování svých práv a při plnění povinností při náhradě.This thesis deals with moral aspects of compensation of damage viewed as a correlation that arrises between the agrieved party and the one causing the damage. Due to the fact that the compensation of damage institute can not be separated from justice and law to which it is closely connected, the thesis involves a widely elaborated subject of justice and law within its development in the frame of historical context. Special attention is paid to the evolution of the thoughts about law, justice and compensation of damage in the age of classical Greek philosophy but espacially to biblical concept emphasising the change of perception of the meaning of these terms in the New Testament against the Old Testament. With the same interest the thesis addresses also contemporary theories of justice from the theological viewpoint with the justice of exchange (commutative) being in the centre of interest. Within the dealing about justice in terms of cardinal virtue the act of compensation is considered in the light of moral and ethic pronciples including some trespasses against them. Moreover the thesis includes some practical recommedations to Christians upon setting up their claims and performing their duties during compensation.
