Tato práce se zabývá tématem dereifikace zvířete v českém právu. Toto téma bylo zvoleno z důvodu přicházející rekodifikace českého soukromého práva. V rámci této rekodifikace dojde ke změně v chápání pojmu zvířat. V současné soukromoprávní úpravě platí, že zvíře je považováno za věc. Nově, od vstupu nového občanského zákoníku v účinnost, již nebude zvíře věcí. Hlavním cílem této práce je poukázat na změny, které nastanou s přijetím nové soukromoprávní úpravy. Dalším cílem je podat ucelený výklad týkající se úpravy zvířat v českém prostředí. Nelze se totiž věnovat určitému tématu, které se váže na velkou celospolečenskou změnu, bez znalosti ostatních souvislostí. Tato práce postupně podává výklad o historii zvířat jako právního pojmu a s tím související úpravy věcí. Také se věnuje současné úpravě zvířat, věcí a podává také výklad týkající se vlastnictví věci, jakožto institutu, který se bezprostředně věcí týká. Pro celistvý pohled na problematiku je věnován prostor i veřejnoprávní úpravě právního statusu zvířat. Dále se tato práce zaměřuje na změnu právního postavení zvířete v českém právu v podobě tzv. dereifikace. Ukazuje, jakou právní cestou dojde k odvěcnění zvířete, kde všude se tyto změny projeví a předkládá pro srovnání zahraniční úpravu. Dále ale také např. poukazuje na názorové rozdíly v rámci příprav nové právní úpravy a pokouší se popsat potíže při pokusech definování pojmu zvíře.This thesis handles the topic Dereification of animals in Czech law. This topic was chosen because of the incoming recodification of Czech private law. This recodification will change our understanding of the concept of animals. In actual private treatment are the animals considered as a thing. Recently, since the entry of the new Civil Code in force, animals are no longer considered as a thing. Main aim of this thesis is to point out the changes that are about to come with the adoption of new private law adjustment. Other aim is to provide a comprehensive explanation concerning the adjustment of the animals in the Czech environment. It is impossible to pursue a specific subject which binds to a big change in whole society as a whole, without the knowledge of the other contexts. This work gradually interprets the history of animals as a legal concept and the related adjustments. It also deals with the current treatment of animals, things, and serves as an interpretation regarding property ownership, as an institute that is directly related to the topic. For a solid overview of the issue there is dedicated place to the regulatory arrangements of the legal status of animals. Furthermore, this thesis focuses on the change in the legal status of the animals in the Czech law in the form of so-called Dereification. It shows how legally dereification animal where will these changes take effect and presents a comparison of foreign regulation. Furthermore, as well points to differences in the preparation of new legislation, and attempts to describe the difficulties in defining the concept of animal experiments.
