Název diplomové práce zní "Princip proporcionality v judikatuře Ústavního soudu ČR." Stanoveným cílem je shrnutí vývoje tohoto právního nástroje v České republice v průběhu demokratického éry, která započala v roce 1989. První část pojednává o samotné problematice pojmu "právní princip" z hlediska sporů mezi pozitivisty a iusnaturalisty. Dále je věnován prostor základním ideovým zdrojům, na kterých byl princip proporcionality vystavěn, konkrétně jde o doktrínu Roberta Alexyho a její následnou kritiku jak v literatuře zahraniční, tak i české. Stěžejní část obsahuje analýzu principu proporcionality v konkrétních nálezech Ústavního soudu ČR. Osvětluje důvody pro vytváření rozmanitých struktur v podobě testů vyloučení extrémní disproporcionality, racionality a různorodého pojetí testu proporcionality, který je často vytvářen ad hoc pro konkrétní případ a má též odlišnou strukturu v různých druzích řízení. Závěrečná část pojednává o praxi obecných soudů a správních orgánů při aplikaci daného principu, zda mají povinnost jej použít při své rozhodovací činnosti, zda takto opravdu činí a jaké největší problémy tato aplikace či její nesprávné použití obsahuje. Na závěr je shrnuto, jakým způsobem Ústavní soud používá daný právní prostředek a je nastíněno možné řešení vyvstalých problémů.The title of this thesis is the "Principle of proportionality in the jurisprudence of the Constitutional Court of the Czech Republic". The stated aim is to summarize the development of this legal instrument in the Czech Republic during the democratic era, which began in 1989. The first part analyses the concept of legal issues in terms of the "legal principle" in disputes between positivists and ius naturalists. Further described are basic ideological resources, on which the principle of proportionality is based, namely the doctrine of Robert Alexy and his criticism in foreign literature and also in Czech. The central part contains an analysis of the principle of proportionality in the specific judgements of the Constitutional Court of the Czech Republic. This illuminates the reasons for the creation of multiple structures in the form of extreme disproportionality exclusion tests, rationality test and diverse concepts of the proportionality test, which is often created ad hoc for a particular case and also has a different structure in various types of proceedings. The final part will discuss the general practice of courts and administrative authorities in the application of this principle. If there is an obligation to use it in their decision making process as to whether such really is and what are the biggest problems of this application or incorrect application. Finally, it summarizes how the Constitutional Court uses this legal instrument and outlines possible solutions arising from problems.
