Tato diplomová práce se zabývá problematikou soukromoprávní odpovědnosti sportovců za škodu. Jde o vzájemnou odpovědnost sportovců za sportovní úrazy. Oblast odpovědnosti sportovců je považována za klasický předmět zájmu sportovního práva a právními teoretiky byla řešena od dob antiky. Současný stav české právní doktríny se však vyznačuje zjevným nezájmem o danou oblast, což vede k absenci dostatečného teoretického propracování tohoto tématu a v praxi se následně vytváří stav právní nejistoty. Stěžejní otázkou při posuzování odpovědnosti sportovců byla vždy protiprávnost jejich jednání. Tedy zda lze posuzovat, a jestli ano, tak z jakého důvodu, protiprávnost jednání sportovců odlišným způsobem právě proto, že k tomuto došlo při výkonu sportovní činnosti. Tato práce se tedy zaměřuje na otázku protiprávnosti jednání sportovců a zabývá se také přístupem českých soudů k odpovědnosti sportovců za škodu. Protiprávnost je v této práci zkoumána nejprve v rovině obecné a pak s přihlédnutím ke specifickému charakteru sportu. Specifický charakter sportu se projevuje zejména přítomností určité míry rizika. Protiprávnost jednání sportovců je tak vykládána s ohledem na obecnou legalitu sportu a prvek sportovního rizika. Následovně jsou zkoumány odlišné důvody vzniku protiprávnosti, a to porušení prevenční (zákonné) a smluvní povinnosti. Je analyzován právní základ pro stanovení prevenční povinnosti v českém právním řádu a dovozen správný metodologický postup jejího stanovení. Zkoumána je také povaha sportovních pravidel a jejich význam při určování, zda došlo k porušení prevenční povinnosti. Dále jsou na základě srovnání s anglickou doktrínou, především koncepcí kultury hry, stanoveny další relevantní kritéria při určování, zda došlo k porušení prevenční povinnosti. Je zkoumána existence vzájemných smluvních vztahů mezi sportovci a jejich případný obsah. V rámci těchto smluvních vztahů je pak důraz zaměřen především na souhlas s možnými zásahy do tělesné integrity sportovců. Dále je pojednáno o oprávnění dispozice sportovců s právem chráněnými statky (jejich životem a zdravím) s ohledem na veřejný zájem a autonomii vůle. Analýzou jednotlivých relevantních soudních rozhodnutí je pak zhodnocen postoj českých soudů k problematice odpovědnosti sportovců za škodu.This thesis deals with civil liability for damages caused by athletes. It is the mutual liability of the athletes for sports injuries. The area of civil liability of the athletes is considered to be the sports law's classic object of interest and legal theorists have dealt with it since ancient times. Nevertheless, the current state of the Czech legal doctrine is characterized by apparent lack of interest in the area concerned resulting in the absence of theoretical elaboration of the subject matter and a situation of legal uncertainty in practise then. The unlawfulness of the athletes' actions has always been the key question in assessing their civil liability. Thus, if it is possible, and if so, for what reason, to assess the unlawfulness of the athletes' actions differently just because of the specific circumstances of sport. This thesis thus focuses on the question of unlawulness of athletes' actions and it also deals with the approach of Czech courts to the civil liability of the athletes. The unlawfulness is examined first in general terms and from the point of view taking into account the specific nature of sport then. The specific nature of sport is particularly seen in the presence of some degree of risk. The unlawfulness of the athletes' actions is therefore interpreted in the light of the general legality of sports and the element of risk inherent in the sport. Subsequently there are examined different reasons for imposing unlawfulness depending on whether the duty breached was legal or contractual. The legal basis for imposing the duty of care in the Czech legal system is analyzed and the proper methodology for its imposing is inferred. The nature of sports rules is also examined as well as their importance in determining whether a breach of a particular duty of care has occured. Further, there are provided other relevant criteria in determining whether a breach of a particular duty of care has occured based on a comparison with the English doctrine, especially the concept of the playing culture. Furthermore, this paper examines the existence of mutual contractual relations between the athletes and their possible content. Under these contractual relationships, the emphasis is focused primarily on consent to the potential interference with the physical integrity of the athletes. In addition to that, it is dealt with the authorization of disposition with the athletes' law protected rights (life and health) with regard to the public interest and free will. The Czech courts approach to the issues of civil liability of the athletes is reviewed by an analysis of the relevant judicial decisions then.
